एक आलसी का चिठ्ठा: PIL of 'We, the people'

लड़की की आँखों को देखिये, चेहरे के भाव और देह की भंगिमा देखिये। यह ऐतिहासिक चित्र है। 

यह है स्त्री! केयरिंग, निर्भय और अपने अधिकारों के प्रति सचेत। 

~तुम्हें नमन है~

‘खटखटाहटों पर कोई उत्तर न मिले तो भी अकेले हाँक पारना न छोड़ो!’

सब ओर से चुप्पियों से साक्षात होने के पश्चात मैं सर्वोच्च न्यायालय हेतु जनहित याचिका को स्वयं ड्राफ्ट कर रहा हूँ। 

यह पूरे देश में, हर राज्य में कम से कम एक, त्वरित गति न्यायपीठों (Fast Track Courts) की स्थापना हेतु न्यायिक आदेश देने के लिये है। ऐसे न्यायपीठ उन सभी नये पुराने अपराधों की सुनवाई करेंगे जिनमें बलात्कार स्वयंसिद्ध है। ये न्यायालय ऐसी घटनाओं को स्वयं संज्ञान में भी लेते हुये कार्यवाही सुनिश्चित करेंगे। 

यह अंग्रेजी में हैं क्यों कि हमारे न्यायिक तंत्र की भाषा अंग्रेजी है। यह समय भाषा विवाद में पड़ने का नहीं है। युद्ध के समय शस्त्रास्त्र महत्त्वपूर्ण होते हैं न कि उनके खोल और ढाँचे।

यदि आप इस याचिका में कुछ संशोधन चाहें या कुछ जोड़ना चाहें तो अवश्य बतायें। आधी जनसंख्या को सुनिश्चित और लघु समय सीमा में न्याय (justice) मिलना चाहिये। पूरा संविधान पढ़ने की आवश्यकता नहीं, प्रस्तावना (preamble) ही पर्याप्त है।

All my knocking has gone unheard. I begin to draft PIL myself. You may send me suggestions or if you are a lawyer, you may draft it on my behalf who like you, is a tiny part of the people. But I have no money and I am convinced that this issue is beyond the realms of money.

Hon'ble Chief Justice of India 

I, a common citizen of Republic of India, constitute 'the people' which has given the constitution to itself. I have proclaimed myself in the preamble to the constitution and today I am before you in the supreme temple of justice asking for the justice.

All I could do was to read the preamble. I can understand only one word JUSTICE in the present context, though I can't express it eloquently. I have a firm belief that this understanding is universal and with this understanding I am before you demanding justice for half of 'the people'. 

I am before you for better half of the people which also is mother in lineage of earth, the mother.

I am before you for that half which ensures continuity of life carrying the future of the people in her womb.

I am before you pleading that she does not delay in deliverance of life but justice has always been a delayed affair for the crimes committed against her just for the fact that she carries organs to bring life on the earth.

 
I am before you to proclaim that these crimes are against the life and I know that in the pages following the preamble it is written that life is a fundamental right.

I am before you for that fundamental right and when I say fundamental, I just know the fundamental beyond technicalities.

 
I am before you for I know that you understand me.

 
I am before you to be my pleader to plead on my behalf with yourself and pronounce that justice must be delivered in a fixed time frame and with all the precision, correctness and effectiveness it deserves for it links to the mother who delivers timely, effectively, precisely to ensure continuity of life and continuity of 'We the people'....
